Do not limit protection against workplace harassment

The A.L.E.G. Association, alongside 28 civil society organisations, is calling on the drafters of Bill L445/2026 to remove the proposed amendments to Government Ordinance No. 137/2000 on the prevention and punishment of all forms of discrimination, specifically regarding psychological harassment in the workplace.

Although the draft bill primarily concerns pay transparency and equal pay between women and men, the proposed amendments significantly restrict existing protection against psychological harassment. They introduce additional conditions relating to intent, duration and the repetitive or systematic nature of the behaviour, and remove a provision that currently offers protection against certain forms of psychological harassment.

These changes are incompatible with ILO Convention No. 190 on violence and harassment in the world of work, reduce the current level of protection and are not supported by any justification or impact assessment.

The organisations are calling for the amendments concerning psychological harassment to be removed from Bill L445/2026 and, should a review of the legislative framework be necessary, to be considered through a separate legislative process, underpinned by consultation and an impact assessment.
